One of the most important checks and balances agreed to by our Founders is the rule of apportioning both Representatives and “direct taxes”. And the rule was also intended to apply to any money returned to the States by the federal government! This rule prevents the Democrat Party’s “free cheese” crap we now suffer under since it requires each State’s share of Medicaid money received from the federal government to be proportionately equal to it Representation in Congress and/or its share of any direct tax laid by Congress.


In any event, in support of my above claim [the rule of apportionment must apply to federal funding of Medicaid] see Act of Congress in June of 1836 in which all surplus revenue in excess of $ 5,000,000 was decided to be distributed among the states, and eventually a total of $28,000,000 was distributed among the states by the rule of apportionment in the nature of interest free loans to the states to be recalled if and when Congress decided to make such a recall.


Perhaps someday in the near future one of our nationally syndicated media personalities will discuss the merits and wisdom of our Constitution’s rule of apportionment.

Here is how Trump can close down the federal Department of Education

Then why are we in debt?
Because the scumbags in Washington ignore our Constitution and its legislative intent.

In any event, here is how Trump can close down the federal socialist Department of Education.

All that Trump needs to do to help drain the socialist swamp in Washington is to threaten, and carry through with vetoing, any bill which doles out federal money to the States which does not follow the rule of apportionment.

He should start with the federal Department of Education and demand all money doled out from the federal government to the states used for education must be apportioned as our founders intended, and also demand to have a provision in the bill laying an apportioned direct tax on the states to cover the cost of federal funding of education. You would see our big socialist states like California and New York suddenly crying that the federal government has no business meddling in their State public school system in order to avoid the apportioned direct tax which would deplete their own State Treasury!

Let us not forget the very intentions spoken by Pinckney when addressing the S.C. ratification convention with regard to the rule of apportionment :

“With regard to the general government imposing internal taxes upon us, he contended that it was absolutely necessary they should have such a power: requisitions had been in vain tried every year since the ratification of the old Confederation, and not a single state had paid the quota required of her. The general government could not abuse this power, and favor one state and oppress another, as each state was to be taxed only in proportion to its representation.” 4 Elliot‘s, S.C., 305-6

Then why are we in debt?
Because most of congress & recent Presidents either don't know how or refuse to live within the means of the tax money generated by the people, insisting instead on borrowing money to pay for social programs that continue to garner them votes every two-four years so that they can stay in office and enjoy the power & perks that come with it.

Fair share balanced budget amendment

Agreed! Now, just imagine if Congress were required to lay a direct apportioned tax at the end of any fiscal year in which there was a deficit, i.e. The fair share balanced budget amendment.

The Fair Share Balanced Budget Amendment is as follows:


“SECTION 1. The Sixteenth Amendment is hereby repealed and Congress is henceforth forbidden to lay ``any`` tax or burden calculated from profits, gains, interest, salaries, wages, tips, inheritances or any other lawfully realized money.

NOTE: these words would return us to our founding father’s ORIGINAL TAX PLAN as they intended it to operate! They would also end the experiment with allowing Congress to lay and collect taxes calculated from lawfully earned "incomes" which now oppresses America‘s economic engine and robs the bread which working people have earned when selling their labor!

"SECTION 2. Congress ought not raise money by borrowing, but when the money arising from imposts duties and excise taxes are insufficient to meet the public exigencies, and Congress has raised money by borrowing during the course of a fiscal year, Congress shall then lay a direct tax at the beginning of the next fiscal year for an amount sufficient to extinguish the preceding fiscal year's deficit, and apply the revenue so raised to extinguishing said deficit."

NOTE: Congress is to raise its primary revenue from imposts and duties, [taxes at our water’s edge], and may also lay miscellaneous internal excise taxes on specifically chosen articles of consumption. But if Congress borrows and spends more than is brought in from imposts, duties and miscellaneous excise taxes during the course of a fiscal year, then, and only then, is the apportioned tax to be laid.

"SECTION 3. When Congress is required to lay a direct tax in accordance with Section 1 of this Article, the Secretary of the United States Treasury shall, in a timely manner, calculate each State's apportioned share of the total sum being raised by dividing its total population size by the total population of the united states and multiplying that figure by the total being raised by Congress, and then provide the various State Congressional Delegations with a Bill notifying their State’s Executive and Legislature of its share of the total tax being collected and a final date by which said tax shall be paid into the United States Treasury."

NOTE: our founder’s fair share formula to extinguish an annual deficit would be:

The above formula, as intended by our founding fathers, is to insure that those states who contribute the lion’s share of the tax are guaranteed a representation in Congress proportionately equal to their contribution, i.e., representation with a proportional financial obligation!

Note also that each State’s number or Representatives, under our Constitution is determined by the rule of apportionment:

"SECTION 4. Each State shall be free to assume and pay its quota of the direct tax into the United States Treasury by a final date set by Congress, but if any State shall refuse or neglect to pay its quota, then Congress shall send forth its officers to assess and levy such State's proportion against the real property within the State with interest thereon at the rate of ((?)) per cent per annum, and against the individual owners of the taxable property. Provision shall be made for a 15% discount for those States paying their share by ((?))of the fiscal year in which the tax is laid, and a 10% discount for States paying by the final date set by Congress, such discount being to defray the States' cost of collection."

NOTE: This section respects the Tenth Amendment and allows each state to raise its share in its own chosen way in a time period set by Congress, but also allows the federal government to enter a state and collect the tax if a state is delinquent in meeting its obligation.

"SECTION 5. This Amendment to the Constitution, when ratified by the required number of States, shall take effect no later than (?) years after the required number of States have ratified it.

Why America’s taxpayers should demand apportionment of federal outlays to states

Getting back to the subject of the thread See Congressional Seats and Federal Outlays

”Most Americans know that their representation in the U.S. House of Representatives is based on proportional representation as determined by the decennial Census. And, many Americans are aware that the Census takers try to count everybody residing in the country. But, most Americans do not make the connection that illegal immigrants and other foreigners who are not legal permanent residents are part of the calculation for the apportionment of Congressional representatives. If the population of illegal aliens and other long-term foreign residents were inconsequential, this would not be an important issue. However, with 22.5 million non-U.S. citizen foreign residents counted in the 2010 Census, this is a valid major concern.

Because illegal aliens should not even be in the country, and other nonimmigrants such as foreign students and guest workers are here only temporarily, it makes no sense to distribute Congressional seats as if these foreign nationals deserved representation the same as American citizens.

The U.S. population that logically should be enumerated includes U.S. citizens and legal permanent residents (immigrants). As only the former may vote in federal elections, the apportionment of seats in Congress should be done on the basis of the number of U.S. citizens in each state.1 Similarly, apportionment of federal funds should be based on the number of citizens and legal residents of each state.”


According to Pew Research, California has the largest number of illegal aliens in the United States and they are counted during the census which gives California its apportioned but overwhelming Congressional Representation. But when it comes to paying an apportioned share of federal taxes, its share is far below that which is demanded by the rule of apportionment. In order to make America great again, it’s time to demand that the socialist loving state of California pay its apportioned share of federal taxes equal to its big fat mouth in Congress when spending federal revenue. If the rule of apportionment as applied to federal taxation were enforced as intended by our Founders, California and its Socialist loving Congressional Delegation would quickly learn there is no federal “free cheese wagon”.

Why do Texans allow themselves to get screwed by socialist California?

The same statistics can be found at various other locations.


According to the following, California paid far less than Texas per capita but got far more.

BOTTOM LINE:**"California paid LESS to the feds per capita than Texas.* California got MORE back per capita from the feds than Texas".



In addition, under the rule of apportionment California got 53 Representatives while Texas only got 36 Representatives even though it pays more per capita in federal taxes.

Our Fifth Column media

I have noticed over the years that our popular media personalities avoid talking about two key issues which made our Constitution possible. The first is the merits and wisdom of our Constitution's original tax plan, and especially its rule of apportionment. The second is the founders’ specific intention to forbid notes of any kind, and this would include "Federal Reserve Notes", to be made a legal tender in payment of debt. As long as we have a dishonest taxing system and corruptible money, our Washington Establishment is free, using these two tools, to plunder the real material wealth created by America’s labor and businesses.

And with reference to the media personalities I mentioned, this would include Rush Limbaugh, Glenn Beck, Laura Ingraham, Schnitt, Mark Levin, Dennis Prager, Bill O'rielly, Mike Gallagher, Doc Thompson, Lee Rodgers, Neal Boortz, Mike Huckabee, Tammy Bruce, Monica Crowley, Herman Cain, Eric Bolling, Kimberly Guilfoyle, Greg Gutfeld, Dana Perino, Juan Williams, Megyn Kelly, Neil Cavuto, John Stossel etc., etc., who, to the best of my knowledge have never discussed tax reform as our Founders did during the framing of our Constitution, or discussed our Founder’s specific forbiddance to allow notes of any kind ___ and this would include Federal Reserve Notes __ to be made a “LEGAL TENDER FOR ALL DEBTS PUBLIC AND PRIVATE”!
