NJ Division of Fish and Wildlife sent a "package" of regulatory changes to the DEP in 2007. This is usually done on a yearly basis. The 2007 package became the 2008 package. The 2008 package became the 2009 package. All with changes to keep up with the mandates of the Atlantic States Marine Fisheries Council and Mid-Atlantic Fisheries Management Council (mostly the Commission). The DEP finally acted on the package and sent it to the Governor's office in Sept 09' for their review and subsequent publishing in the NJ Register. It has been sitting on the Governor's Desk since Sept. It is not a "bill".
Last week the ASMFC found NJ out of compliance with the shark plan. This finding will work it's way to the Secretary of Commerce. If he agrees, he will send a letter to NJ formally telling us that we cannot land sharks in NJ.
Bottom line is no matter how many tournaments are scheduled, unless NJ comes back into compliance no one will be allowed to land a shark in NJ. This is assuming that the Secretary of Commerce will agree with the ASMFC. From my perspective, I don't see any reason why the Secretary of Commerce would not find NJ out of compliance.
